Independent Contractor Agreements


For many years now, the status of Independent Contractors has fallen into a 'grey area' in Queensland's Real Estate Industry, largely because of the inadequacy of legislation dealing with this topic.  As a result, there has often been conflicting advice given as to Independent Contractors and their relationship with various awards, licensing legislation, professional indemnity insurance, workers compensation, etc.

What all 'best practice' contracting organisations agree on, however, is the principle underpinned by all 'real estate' awards - to enhance transparency and fair dealing, it is in the interests of both parties:

  1. to have an agreement signed between the business owner and the contractor, clearly setting out their business relationship; and
  2. that a copy of the agreement be registered with an independent organisation.
